Welcome to Habitat Verre. In this document, the terms "we", "us", "our" and "Habitat Verre" refer to Habitat Verre Inc. (Quebec Business Number 1177895522), a Quebec-based company with its head office at 301-3008 rue Brodeur Ouest, St-Alphonse-de-Granby, Quebec J0E 2A0.
Habitat Verre operates the online store and all related content, features, tools, products and services (collectively, the "Services"). The Services are powered by the Shopify Inc. platform.
These Terms of Service, together with the policies referenced herein (collectively, the "Terms"), describe your rights and responsibilities when using the Services. Please read them carefully: they contain important information about your legal rights, including warranties and limitations of liability.
By visiting the website, interacting with the Services or placing an order, you agree to be bound by these Terms as well as by our and our . If you do not accept them, you must not use the Services.
SECTION 1 — ACCESS AND ACCOUNT
By accepting these Terms, you represent that you have reached the age of majority in your province, state or country of residence, or that you have obtained the consent of a parent or legal guardian to accept them on your behalf.
To use certain features of the Services — in particular to place an order — you may be required to provide accurate and complete information (name, email address, billing and shipping address, payment method). You represent and warrant that all such information is true and up to date.
You are solely responsible for the confidentiality of your account credentials and for any activity carried out from your account. You may not assign, sell or transfer your account to a third party.
SECTION 2 — OUR PRODUCTS
We make every effort to present our products and services as accurately as possible. However, colours, finishes and visual appearance may vary from one screen to another depending on your device and its settings. Dimensions and technical drawings are provided for information purposes only.
All product descriptions are subject to change without notice. We reserve the right to discontinue a product, to limit the quantities sold to any single customer, or to restrict sales to certain regions or jurisdictions, at our sole discretion.
SECTION 3 — ORDERS
Any order placed constitutes an offer to purchase. It is confirmed only upon receipt, by email, of an explicit order confirmation from Habitat Verre. We reserve the right to refuse or cancel any order, in whole or in part, including in cases of invalid payment information, suspected fraud, pricing errors, stock unavailability or logistical constraints.
Any cancellation request must reach us before production or order preparation begins. After that, cancellation may be refused or subject to fees.
Returns and exchanges are governed by our , which provides for a 30-day return window and a 20% restocking fee on returned tempered glass panels.
You represent and warrant that your purchases are intended for personal, professional or commercial use within Canada and not for resale abroad.
SECTION 4 — PRICES, TAXES AND BILLING
Prices are displayed in Canadian dollars (CAD) and do not include applicable taxes (GST, QST, or HST depending on the province), shipping fees, pickup fees or any applicable customs duties. The price charged is the one in effect at the time the order is placed and confirmed in the order confirmation email.
Promotions and promotional codes may be subject to specific conditions that prevail, in case of conflict, over these Terms.
You agree to provide accurate, complete and up-to-date payment information. You represent that you are authorized to use the payment method provided and confirm that the amounts charged will be honoured.
SECTION 5 — SHIPPING, DELIVERY AND PICKUP
Delivery terms, pickup at the St-Alphonse-de-Granby warehouse and pickup at our Quebec City, Montreal and Ottawa collection points are described in detail in our .
All shipping and delivery timeframes are provided as estimates only and are not guaranteed. Habitat Verre cannot be held responsible for delays caused by carriers, customs or any event beyond its control.
Title and risk of loss transfer to you upon receipt or pickup of the products.
SECTION 6 — INTELLECTUAL PROPERTY
All content within the Services — texts, photographs, illustrations, videos, technical drawings, logos, trademarks, source code and their selection, arrangement and layout — is the exclusive property of Habitat Verre Inc., of its supplier partners (notably Sol Pergolas and GSQ) or of its licensors, and is protected by Canadian and international laws on copyright, trademarks and intellectual property.
These Terms grant you a limited, non-exclusive and non-transferable licence to use the Services for personal or internal professional purposes. Any other use — reproduction, distribution, modification, republication, scraping, training of artificial intelligence models, or commercial exploitation — requires our prior written consent.
"Habitat Verre" and its associated logo are trademarks of Habitat Verre Inc. Other trademarks mentioned (Sol Pergolas, EZfence, EZdeck, ORANA, ZENA, AMARA, etc.) remain the property of their respective owners.
SECTION 7 — OPTIONAL THIRD-PARTY TOOLS
The Services may integrate tools or widgets provided by third parties (forms, calculators, chat, payment modules, etc.). These tools are provided "as is" and "as available", without any warranty on our part. Your use of these tools is at your sole risk and is governed by the terms of their respective providers.
Any new feature added to the Services later will also be governed by these Terms.
SECTION 8 — LINKS TO THIRD-PARTY SITES
The Services may contain hyperlinks to third-party websites that we do not operate and whose content we do not control. We disclaim any liability regarding their content, privacy practices or commercial offerings. Access to these websites is at your sole risk.
SECTION 9 — RELATIONSHIP WITH SHOPIFY
The habitatverre.ca website is powered by Shopify Inc., which hosts and operates the technical platform. However, any sale or purchase transaction is concluded directly with Habitat Verre Inc. By using the Services, you acknowledge that Shopify is not responsible for any aspect of your commercial relationship with Habitat Verre, and you release Shopify and its affiliates from any claim arising from a purchase or transaction.
SECTION 10 — PRIVACY POLICY
All personal information collected through the Services is governed by our , which complies with Quebec's Act respecting the protection of personal information in the private sector (LPRPSP — "Law 25").
Certain data may also be processed by Shopify under its own privacy policy, available at . By using the Services, you acknowledge having reviewed both policies.
SECTION 11 — COMMENTS AND CONTRIBUTIONS
If you submit ideas, suggestions, testimonials, photographs, reviews or any other content ("Contributions"), you grant us a perpetual, worldwide, non-exclusive, royalty-free and sublicensable licence to use, reproduce, modify, translate, publish and exploit such Contributions for any purpose, including commercial, with no obligation of compensation or confidentiality.
You represent and warrant that (i) you hold all rights to the Contributions; (ii) they do not infringe any third-party rights (copyright, trademark, privacy, image); and (iii) they contain nothing unlawful, defamatory, obscene or harmful.
We may, but are not required to, moderate, edit or remove any Contribution deemed inappropriate.
SECTION 12 — ERRORS, INACCURACIES AND OMISSIONS
Despite our efforts, the content of the Services may contain typographical errors, inaccuracies or omissions (descriptions, prices, promotions, availability). We reserve the right to correct any error and to cancel orders affected by erroneous information, even after submission, and to refund in full any amounts already collected where applicable.
SECTION 13 — PROHIBITED USES
You may use the Services only for lawful purposes. The following uses are prohibited:
- using the Services for illegal, fraudulent or malicious purposes;
- violating any applicable law or regulation;
- infringing the intellectual property or privacy rights of others;
- harassing, intimidating, disparaging or defaming anyone;
- transmitting false, misleading or unsolicited information (spam, phishing);
- impersonating another person or entity;
- uploading viruses, malware or harmful code;
- collecting, indexing or scraping the website's data, or using such data to train artificial intelligence models, without our prior written consent;
- circumventing the security mechanisms or accessing the Services by unauthorized automated means.
We reserve the right to suspend, disable or terminate your account without notice in the event of any violation.
SECTION 14 — TERMINATION
We may terminate this agreement or your access to the Services at any time, without notice, at our sole discretion. You remain liable for any amounts due up to and including the date of termination.
The following sections shall continue to apply after any termination: Intellectual Property, Comments and Contributions, Termination, Warranties, Limitation of Liability, Indemnification, Severability, Waiver, Entire Agreement, Assignment, Governing Law and Privacy.
SECTION 15 — WARRANTIES
Quebec legal warranty. In accordance with Quebec's Consumer Protection Act, our products are covered by the applicable legal warranties, including the warranty of quality and the warranty of fitness for purpose. Nothing in these Terms is intended to reduce these warranties.
Outside the legal warranty, and to the extent permitted by law, the Services and the products are provided "as is" and "as available", without any other express or implied warranty (merchantability, fitness for a particular purpose, uninterrupted operation, accuracy). We do not warrant that the Services will be uninterrupted, secure or error-free.
SECTION 16 — LIMITATION OF LIABILITY
To the extent permitted by applicable law, and subject to the rights granted by Quebec's Consumer Protection Act, Habitat Verre Inc. and its officers, employees, agents, affiliates, partners and suppliers shall in no event be held liable for any indirect, incidental, special, punitive or consequential damages (lost profits, lost data, loss of use, replacement costs) arising from the use of the Services or the products, whether based on contract, fault or any other legal basis.
Our total liability, regardless of the legal basis, is limited to the amount you actually paid to Habitat Verre for the order giving rise to the dispute.
SECTION 17 — INDEMNIFICATION
You agree to indemnify and hold harmless Habitat Verre Inc., Shopify and their officers, employees and partners from any claim, loss, damage, liability or expense (including reasonable attorneys' fees) arising from (i) your breach of these Terms, (ii) your violation of the rights of a third party, or (iii) your use of the Services in contravention of the law.
SECTION 18 — SEVERABILITY
If any provision of these Terms is held to be unlawful, void or unenforceable by a court of competent jurisdiction, that provision will be enforced to the fullest extent permitted by law, and the remainder of the Terms will remain in full force and effect.
SECTION 19 — WAIVER — ENTIRE AGREEMENT
Our tolerance of any breach of any provision of the Terms shall not constitute a waiver of that provision.
These Terms, together with the policies published on the website, constitute the entire agreement between you and Habitat Verre Inc. and supersede any prior agreement, communication or proposal, oral or written.
SECTION 20 — ASSIGNMENT
You may not assign or transfer this agreement or your rights without our prior written consent. Habitat Verre Inc. may assign its rights and obligations to any successor, acquirer or affiliate without your consent.
SECTION 21 — GOVERNING LAW AND JURISDICTION
These Terms are governed by the laws in force in the Province of Quebec, Canada and the federal laws of Canada that apply therein. Any dispute shall fall under the exclusive jurisdiction of the courts of the judicial district of Bedford (Quebec), subject to the rights granted to consumers by Quebec's Consumer Protection Act regarding the choice of forum.
The United Nations Convention on Contracts for the International Sale of Goods (CISG) is expressly excluded.
SECTION 22 — HEADINGS
The headings and subheadings of these Terms are provided for convenience only and do not limit or affect their meaning.
SECTION 23 — CHANGES
We reserve the right, at our sole discretion, to modify these Terms at any time. The version in force is always available on this page, dated at the top of the document.
For any material change, we will notify you through a notice posted on the website or by email, in accordance with applicable law. Continuing to use the Services after a modification takes effect constitutes your acceptance of that modification.
